Nxera Digital LLC, doing business as CueHQ (“CueHQ,” “we,” “us”), respects intellectual property rights and responds to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (“DMCA”).
1. Reporting alleged infringement. If you believe content available through the Service infringes a copyright you own or control, send a written notice to our designated agent at info@cuehq.social with the subject line “DMCA Notice.” Your notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work you claim is infringed; (c) identification of the material you claim is infringing and information reasonably sufficient to let us locate it; (d) your contact information, including name, address, telephone number, and email; (e) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
2. Our response. On receiving a valid notice, we will remove or disable access to the material in question and will take reasonable steps to notify the user who provided it. We may forward your notice, including your contact information, to that user.
3. Counter-notification. If you believe material of yours was removed or disabled by mistake or misidentification, you may send a counter-notification to info@cuehq.social including: (a) your physical or electronic signature; (b) identification of the material and its location before removal; (c) a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and (d) your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for your judicial district, or, if outside the United States, any district in which we may be found, and that you will accept service of process from the complaining party. If we receive a valid counter-notification, we may restore the material in 10 to 14 business days unless the original complainant notifies us that it has filed an action seeking a court order.
4. Repeat infringers. We will, in appropriate circumstances, suspend or terminate the accounts of users who are repeat infringers.
5. Misrepresentations. Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or was removed or disabled by mistake or misidentification, may be liable for damages.
